To me the main issue doesn't revolve around whether there was consideration for the Third Amendment. It's about whether the Third Amedment places FNMA and FMCC in a sound and solvent condition, and whether creditor preference rights are respected in accordance with HERA. In my opinion, the Third Amendment violates HERA and does not put FNMA and FMCC in a sound and solvent condition. FNMA and FMCC are vital to the U.S. housing market. They should be reformed and released. Do away with the Third Amendment and place them in a sound and solvent condition.
