If it were 1925 and he wanted to punish the booze smugglers and bootleggers at the time, would he have taken the idea of a death penalty for them? (Of course it was used a lot more back then anyway). Recall that prohibition fell partly because they made possession of booze a felony (5 years in prison). This according to Last Call meant mass jury nullification over the law, and the 21st amendment came in very soon thereafter.
