Since when does something become legal just because it is commonplace? Even worse, not just commonplace... but commonplace in a set of private transactions that are esoteric and not at all scrutinized, by similar people engaged in similar activities? (go listen to the NPR "this American Life" on Magnetar, a week ago.).

Fraud is fraud, even if it is well-hidden in synthetic CDOs. I am really happy we are finally seeing some scrutiny of the shadow markets that almost took the world economy down, and made the inside few extremely rich. These few that played on the edge or even well into the range of deeply fradulent, need to get close attention.
