What about special ed and discipline problems?

I understand that Charter schools can refuse special ed students, and expel discipline problems to the public schools. If you put a requirement that the charter schools be open to all comers with no ability to not enroll some students then it might be fair as it is all the problems will be dumped on the public schools setting them up to continue to fail.
