If you want to go there, then Utah has a problem.

When Utah (and some other states) where admitted they pledged to never allow polygamy. You would have to modify the act of admission to remove the restriction or the courts would still be involved. Recall that polygamy was the second rock of barbarism before the civil war, and that Utah did not get admitted until the president of the Mormon church had a revelation that polygamy was no longer ok.
