There are insufficient resources to prosecute everyone, so examples are made and the hope is that that will serve as a deterrent to others, (they could get caught). Now the crime in question determines how much law enforcement cares. For example in big cities cops and courts just don't care about burglaries, they take the report and file it. (It is against the law but...)

What is happening is more and more people are discovering this secret and as a result, more think they can get away with it. (In addition having filled our prisons with drug users we have no place to put anyone else) (Excuse the cynicism but the older I get the more cynical I get)
