Mr. Pomerantz has the right to express his view that Trump has committed crimes. The First Amendment permits that, just as it permits Trump to call the first person to beat him in the popular vote "crooked Hillary". Not being the DA, Pomerantz did not have the right to indict Trump and he didn't do that.
