Although the Dred Scott decision did not rely on it in its logic, one could used the 9th as a ground to decide the way it was done. Note that in Border States it took the 13th amendment to overturn the Dred Scott decision, (as well as 400000 killed in action) This precedent suggests that for a national abortion prohibition it would take a constitutional amendment just like it took one to establish alcohol prohibition.
