I think that a better way would be to forbid the bank from buying Director and Officer Insurance (D&O Insurance).

Since each of the directors and officers would know that he (or she) is on the hook for the bank's obligations down to his underwear, he would follow responsible policies that would avoid bank failure.

I believe that Warren Buffett's Berkshire Hathaway Corporation does not buy D&O Insurance.
