It may well be structured as there is imposed a tax on incomes of $750 per person in addition to all other taxes. Then we will give you a $750 credit if you have health insurance. Since the constitution does not define limits on how the income tax can be imposed "income tax on all incomes no matter how derived" this is by definition constitional. This is why it is being done thru the income tax.
