You don't respond to Barton's complaint that Apple lied to him? If they felt the questions were inappropriate, they could have said so in the letter but they should not have lied.

Agreed. Though the congressman could then have subpoenaed the answers. I think Apple would argue that while they may have supplied false information they didn't know it was false and they didn't intentionally mislead — when they answered the letter they didn't know the phones were collecting the info they were collecting.
