There is a short stop of the Masters degree that takes typically 2 years. It could be that the student needs to get a Masters to get the green card. (It would take a year or more to get the idea to the point where one can go for funding, unless the goal is to avoid having the school take the idea, often students a required to sign an assignment of inventions nowdays so the school can profit from any ideas).
