Why not a longer holding period for the lower cap gains rate

Say the current rate for from 1 year to 5 years and the lower rate after 5 years (to partly make up for inflation). Of course if I could dictate there would also be a very short term cap gains rate for less than 2 days of 50% because such short term trading is not investing but gambling.
