You are right about point 3 by the editor. (Glad you didn't pull a punch in your wording.)

But there is a another reason this is a completely off-the-mark point.

The editor says: "the penalty for being uninsured isn't being thrown in jail or being deported but paying a tax," The power of taxation is the power of the gun (and of prison). If you don't pay the tax, you can end up in jail. This statement makes no sense, unless I'm unaware that this tax with no repercussions.
