The answer to the question you posed can be found in another NY Times article. The other one is by Robert Shiller (yes that Shiller) about the problem of 'collectice action'. http://www.nytimes.com/2012/06/24/business/economy/real-estates-collective-action-problem.html

Another part of the reason is that the 'pooling agreements' do not allow for changes as the need for changes were not anticipated.
