If you had read the Dartmouth report that detailed the regional variation of treatment it is clear that standard treatment protocols are needed. Of course this also solves the malpractice problem, if you simply define that it is not malpractice to follow the standard treatment protocols, and any suit on that basis gets bounced on day 1. The problem is that fee for service creates at least an apparent conflict of interest. Note that studies show fewer visits with physician employees than stand alone physicians.
