John C. Calhoun could well have proposed this, it's close to his view of nullification that almost brought the Civil War on 30 years earlier. As with a number of posts, people forget that there was a extralegal process that changed the meaning of the constitution Scalia et.al. not withstanding that cost the U.S. 400,000 lives to do called the civil war. For example if you read the Constitution it is not clear that states can not secede, but the Civil War settled the issue. The 10th amendment's meaning got alterered by it, and explicitly by the 14th, which overrides a good bit of the 10th.
