Hamel (United States), Apr 3, 2014 10:59 ...to the two non-lawyers you cite, it was evidently a close call; most cases that go to the Supreme Court are -- even a 9-0 case has seen highly skilled jurists at the circuit level take differing views. Four justices considered this law constitutional. McCain and Bush were doing their best -- the fact that we thought they were wrong-headed on this one and that the Supreme Court ultimately agreed with us shouldn't impugn their good faith efforts to defend the Constitution. Put differently, if you prefer -- their support of this law would have reflected just as poorly on them if one justice had voted the other way (or even if it had gone 9-0 against us).
