During that time the court moved to the right. One more anti-choice vote and Roe is gone. I tend to subscribe to the belief that the Republican politicians (many at least) do not actually want to overturn Roe because it would energize many voters on the Democratic side, but if Stephens were replaced by an anti choice vote, which would have seemed likely in a McCain-Palin administration (he is 89 afterall), then Roe would be overturned. Roberts and Alito, contrary to what they said during confirmation hearings, have very little regard for precedent and would surely overturn precedent, just like they are consistently overruling elected bodies. We sure have an activist court, just not in the way the media reports it.
