It's a private estate tax, that you can pay now with trusts or the like or pay later thru probate. For example if you own land in a state other than the one you live in you get to pay a lawyer in that state to open a probate case for the land in the state where it is located. If we want to go after the estate tax, let's also go after the private estate tax (legal fees often based on a percentage of the estate).
