I think he misunderstood the "necessary and proper" clause. It doesn't say congress can make any law it wants, it says it can make necessary laws to execute the powers enumerated by the constitution or in the founders -- and Stengel's -- words , 'for carrying into Execution the foregoing Powers, and all other powers vested by this Constitution."
