This has occurred with cb and other radio antennas until the FCC solved that one. In many areas in addition the homeowners association can also forbid such a garden. The city has an interest in safe structures as well, as I suspect the company holding the homeowners policy, since a windstorm could blow the structure onto a car or another house, resulting in a liability claim.
