Other than being judeao christian they are not explicitly a relgious group, nor do they claim to be, so that the first amendment on religion does not apply. (Further if they were a religious group it would be illegal for them to recieve some of the government aid they get, such as logistics at jamborees from the Army). You can't have it both ways. If they want to go fully private and decline all direct or indirect government support (including local scout houses then they should do so). To note that 50 years ago some lutheran groups did not favor the boy scouts (missouri synod).
