The real issue and answer begins with the stop. The stop comes about due to reasonable suspicion , or as most people would say it, commonsense and experience. Being in the wrong place at the wrong time and acting in the wrong way sets off anyones alarm bells, so does looking like your a criminal cause you think it's cool. Don't do these things and your chances of being stopped go way way down. Can common sense and experience be abused, yes, but that is the exception. The pat down will never happen if you don't send out the stop me signals. It's not a police state thing it's a stupid person doing stupid things thing.
