If you do not have an income in the subsidy range, and go directly to the insurance company you could always sign up. It is only those who are subsidy eligible (and want it) that needed to use the exchanges. There are also policies outside the exchanges (but follow all the other rules with respect to coverage, out of pocket max, etc) that again if one is not subisdy eligible one can sign up for.
