This comment provides an excellent balancing.
While Trump's posturing by filing a private suit is pretty ridiculous given the hopelessness of any success given the facts and traditions of our legal system, the McCain Feingold Act was a much worse event in our history. Trump's suit is not an attack on the First Amendment directly -- because the Government is not a party to the fight. But the McCain Feingold Law was absolutely inserting the Government into the role of constraining the First Amendment. The Dems should be ashamed, since they are no longer the Dems of the 1960's when the First Amendment was a rallying cry for many of them.
