Oath to uphold the Constitution

Don't all elected Senators and Congressmen, as well as the President and military officers take an oath to uphold the Constitution? Isn't a "law" giving the President powers that the Constitution gives solely to Congress an INVALID ATTEMPTED CONSTITUTIONAL AMENDMENT? Can Congress amend the Constitution by passing a statute? Are there not provisions for amendments that MUST be followed?
