As the highest court in the land, the Supreme Court should be applying the law based on the fundamental principles of the American Constitution and Declaration of Independence.

So I take issue with the "applying the law to the facts" description by the editor, since the proper job of the SC should be to stop wayward actions by the Executive branch or the Legislative branch (or the judicial branch) that violates the individual rights guaranteed by the Constitution (and in the Declaration). The SC isn't primarily a trier of fact, like some lower courts, but a panel of principle. Properly the members should hold the congressional and the executive branches' feet to the fire when they violate the principles that this country was founded on.
But this idea has been mostly lost, and instead the SC gives too much deference to both other branches in their ongoing degradation of the rights of the minority (including the ultimate minority: any individual citizen).
