Roe analogy is not apt.

Reader comment on: Roberts Can Be Proud

I don't think the analogy of the Roe decision is apt. In the Roe decision, the issue of abortion was taken out of the political realm, probably forever.

Had this court overturned ACA, the political realm could deal immediately with it in whatever way deemed necessary. The issue would not be removed from political deliberation as abortion was. The politicians could begin working on new health care legislation tomorrow. In the case of Roe, that option was foreclosed with the decision. Hence, I don't think your comparison of the two cases is appropriate in terms of the political effect.
