State governments can handle torts quite well and if one believes in the 10th amendment it's the place to do it.
Why do this at the Federal level? State government is closer to people in that the most size of the assembly or state house is such that districts are smaller. Clearly there are not enough people to push the state government to change in some states. Texas fixed medical malpractice by limiting non economic damages to 250k. (Economic damages are still unlimited) To fix other states push the state legislature.
