I dunno, I look at it a little differently. If Apple has existing software that will open this phone up, then it has to provide it. The Gov't has an order from a judge - this no different than the execution of any other search warrant. However, I don't think the Gov't is entitled to an order to Apple to create software that doesn't exist today. That's how I split the baby.
