Consistency is what we should strive for. I would however argue that the courts are the larger swing of public opinion even if they were designed not to fear public backlash, like my previous pointed out with slavery. As much as it may hurt my feelings when they pass a judgement I disagree with, it is there job to settle disputes of constitutional question. Also, if I am not mistaken Clinton agreed to doma as a compromise to enacting don't ask don't tell from the previous policy of actively seeking gay servicemen.
