Texting while driving is obviously dangerous. It might also be next to impossible to enforce a ban on doing so. However, pulling up the call detail records of parties involved in fatal crashes should be (if it isn't already) a standard part of accident investigations.
The hazard isn't just in the driver taking his eyes off the road - it's that he becomes mentally absent and focused on the email or conversation. This is why hands-free laws don't reduce accidents and are merely a way for cell phone companies to sell high margin accessories.
