Texting while driving is not a smart thing to do and it involves considerably more attention than clicking on an e-mail to read it - no need to treat the two as if they were the same thing, Mr. Stoll.

But the reason why it has become such a problem is because of the bans on talking on cell phones while driving. Despite the fact that CB radios and walkie talkies have been used in cars for decades without any problems, state legislatures in their infinite wisdom have been banning cell phone use while driving. Its a lot easier to hide texting from the police than it is to hide talking on the phone, so people go for the more dangerous option to avoid the greater risk for a ticket.

Bottom line, talking on the phone in your car should not be illegal.
